Terms of Use

You must be at least the age of majority in your province, state, or country to create an account and make purchases. By using the Service, you confirm that you meet this requirement and that the information you provide is accurate.

You are responsible for keeping your login credentials secure and for all activity that happens under your account. Please notify us promptly if you believe your account has been accessed without your permission. You may close your account at any time.

Lumoriam lets you create tributes, upload photos and memories, invite family and friends, generate tribute videos, and order keepsakes. The Service is available on a free plan and a paid Pro plan. Features, limits, and pricing may change over time, and we will make reasonable efforts to keep this information accurate within the app.

Pro. Pro is a one time purchase made through the Apple App Store or Google Play. It is not a subscription and does not renew.

Render credits. Tribute video renders use credits. Pro includes a number of credits, and additional credits may be purchased as needed.

Memory books. Printed memory books are available to all users and are billed separately. Printing and shipping are fulfilled by a third party print provider.

Refunds. Purchases made through the Apple App Store or Google Play are subject to their respective refund policies. Please direct refund requests for those purchases to the relevant store.

A tribute may include an optional donation fund. Donations are processed by Stripe and paid out to the family member who created the fund. Lumoriam is not the recipient of these funds, does not hold them, and does not take a fee from them.

A donation fund is a private tribute fundraiser, not a registered charity. Donations are not charitable contributions and are not tax-deductible. You are responsible for how you use funds you receive, and any dispute about a donation is between the donor and the person who created the fund. Standard payment processing fees charged by Stripe apply to each transaction.

You retain ownership of the photos, videos, text, and other content you upload ("Your Content"). By uploading Your Content, you grant Lumoriam a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, and display it solely for the purpose of operating and providing the Service to you and the people you invite.

You represent that you have the rights to upload Your Content and that it does not infringe the rights of others or violate any law. You are responsible for Your Content and for having permission to include any people, images, or information within it.

You agree not to use the Service to:

Upload content that is unlawful, infringing, hateful, harassing, or that violates the rights of others.

Impersonate any person or misrepresent your affiliation with any person or entity.

Attempt to access, tamper with, or disrupt the Service, its security, or other users' accounts.

Use the Service for any fraudulent or harmful purpose.

We may remove content or suspend accounts that violate these Terms.

Tributes are private by default. You control who can view and contribute to each tribute through join codes and sharing links. If you choose to share a tribute publicly, you are responsible for that decision and for the content made visible. We will never publicly list or advertise your tribute.

The Lumoriam name, logo, app, design, and underlying software are owned by Lumoriam Ltd. and are protected by intellectual property laws. These Terms do not grant you any right to use our branding or software except as needed to use the Service as intended.

The Service relies on third party providers, including Google Firebase, Stripe, Gelato, Resend, Apple, and Google. Your use of features powered by these providers may also be subject to their terms. We are not responsible for the acts or omissions of third party providers.

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error free, or that content will always be available or preserved.

To the fullest extent permitted by law, Lumoriam and its officers, employees, and providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim arose.

You agree to indemnify and hold harmless Lumoriam from any claims, damages, or expenses arising from Your Content, your use of the Service, or your violation of these Terms or the rights of others.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Provisions that by their nature should survive termination will continue to apply.

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there, without regard to conflict of law rules. You agree to the exclusive jurisdiction of the courts located in Alberta, Canada for any dispute that is not otherwise resolved.

We may update these Terms from time to time. When we do, we will revise the date at the top of this page. If we make material changes, we will provide additional notice within the app or by email. Your continued use of the Service after an update means you accept the revised Terms.
